January 13, 2009: Regular Board Meeting

Mayor Maciol called the regular board meeting to order at 7:04 pm followed by the pledge to the flag and roll call.

Present:  Mayor Maciol, Trustee Bialek, Trustee Jarosz, Trustee McCoy and Trustee Semeniak

OPEN FORUM

William Goodman - asked if anyone has any concerns or questions for him.  Mayor discussed the OTB revenue.

Mark Mojave - asked the Village to acknowledge a new letter from Oriskany Manufacturing asking for a zone change and to take action on the letter.

REGULAR BUSINESS

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept Abstract #8 General vouchers A407-A456 in the amount of $91,850.88 and Library vouchers L076-L085 in the amount of $2,206.33 for a total of $94,057.21.

Trustee Semeniak made a motion seconded by Trustee McCoy to approve the December Treasurers report as presented.  Trustee Semeniak noted that we are getting into some deficits like salt, maintenance for Highway and Police; we need to keep our maintenance logs up to date.

Trustee Semeniak made a motion seconded by Trustee McCoy to approve the minutes of the December 9th board meeting.  Trustee Bialek would like the attorney to check with NYCOM to make sure the vote to spend public funds on the school crossing lights was done properly with two yes votes, one no vote and one abstain.

Trustee Semeniak made a motion seconded by Trustee Jarosz to approve the minutes of the January 5th special meeting/workshop.

DEPARTMENTS

Recreation - Trustee McCoy reported that Holiday on Main Street was a success. The winter months have been quiet.

Police - Sgt Soja gave his report.  Trustee Semeniak made a motion seconded by Trustee Bialek to approve the Police report.

Highway - Joe gave his report which is on file in the Clerk's office.  They replaced the motor on the recycling trailer this week. 

Trustee Bialek thanked the highway department for putting up and taking down the Christmas decorations.

Mayor and board thanked the highway department for the time put in throughout the last two weeks of snow that we had - Thank you.

The Village of Whitesboro's sidewalk plow is down; we have helped them out a few times.  They are asking if we could continue to do so on an hourly basis after we receive heavy amounts of snow.  Joe stated that he could break a man away after their work is done.  They have approximately 14 miles of sidewalk.  Mayor will check to see what the FEMA rate is and the board will discuss further.

Trustee Semeniak made a motion seconded by Trustee Bialek to approve the Highway report.

Fire Department - Resolution 1 for 2009 -Trustee Bialek made a motion seconded by Trustee Semeniak to enter into an agreement with the Town of New Hartford for the 2009 fire contract in the amount of $125,429.00.

Resolution 2 for 2009 -Trustee Semeniak made a motion seconded by Trustee Bialek to enter into an agreement with the Town of Whitestown for the 2009 fire contract in the amount of $109,572.00.

Code Enforcement - Dave his report and stated he denied a demo permit for 44 Greenman Ave.  Handed out proposed revisions to the demolition local law and asked the board to review them.  Resolution 3 for 2009 - Trustee Jarosz made a motion seconded by Trustee Bialek to hold a public hearing on February 10th at 7PM for the demolition revisions.

The Board received a copy of the 2008 building permit lists and certificates Dave received for completed codes classes.

Trustee Jarosz made a motion seconded by Trustee McCoy to approve the Codes report.

Engineer - Al reported the work on the sanitary sewer rehab is continuing, but the weather has stopped them before they were finished.  The sealing of eight manhole walls has been completed.  Shamrock Sewer has cleaned and televised a number of sewers on RT 5A, Henderson and Clinton streets, which will allow Al to finalize the scope of our next sewer sealing project.  They have also removed protruding laterals from several sewers that have been creating maintenance problems, and located at 10" storm sewer between #493 and #497 Main St that heads towards Meadow st.

Trustee Semeniak made a motion seconded by Trustee Jarosz to approve the Engineer report.

Attorney - would like executive session to discuss pending litigation regarding Oriskany Manufacturing.  They are still negotiating with #2 Mill-Liberty Affordable Housing and Broadstreet Warehouse regarding tax issues.

Trustee Semeniak made a motion seconded by trustee McCoy to adjourn the regular meeting and enter into executive session at 7:45 pm to discuss pending litigation pertaining to Oriskany Manufacturing.

Trustee McCoy made a motion seconded by Trustee Jarosz to close executive session and reopen the regular meeting at 7:57 pm with no action taken in executive session.

Broad Street Warehouse LLC has hand delivered a petition for a zoning change from its current designation to M-1.  Mayor stated pursuant to our procedures this now gets referred to the Planning Board for their recommendations.  The next Planning Board meeting will be Thursday January 29th.  Paperwork needs to be submitted to the Planning Board for review.

Resolution 4 for 2009 - Trustee Semeniak made a motion seconded by Trustee McCoy to hold a public hearing February 10th at 7:30 pm on the zone change.

NEW BUSINESS

Towing Rotation Request - Resolution 5 for 2009 - Trustee Jarosz made a motion seconded by Trustee Bialek to add Village Motors Auto Sales to the fifth spot on the towing rotation list.

Federal Infrastructure Funding - Mayor spoke with Assemblywoman Destito on December 19th regarding our Main Street Reconstruction plan and paperwork for 4.4 million in funding was officially filed.

Grant Writer - Board agreed to keep Michael Housecons in mind to write future grants.

NYCOM Legislative Conference - February 22-24th at the Crown Royal in Albany, let Clerk know if interested in attending.

Fire Department Requests - Resolution 6 for 2009 - Trustee Bialek made a motion seconded by Trustee McCoy to allow the following: the NYMFDLA to use the fire house for their annual Ham Dinner February 28th and March 1st; the Red Knights Motorcycle Club to use the fire house on January 15th; and the NYMFD to host the Oneida County Volunteer Firemen's Assoc. meeting on March 19th. 

Election Resolution - Resolution 7 for 2009 - Trustee Bialek made a motion seconded by trustee McCoy to appoint Wanda Miller and Nellie Polczynski as Election Inspectors for the General Village Election on Wednesday March 18th.

Resolution 8 for 2009 - Trustee Jarosz made a motion for the following resolution seconded by trustee Bialek that the village board room, municipal building, 1 Maple Street, New York Mills will be the polling place for the general village election to be held on March 18, 2009 from noon to 9 PM.

Grievance Day Resolution:  Resolution 9 for 2009 - Trustee Bialek made a motion seconded by Trustee McCoy to hold Grievance Day Tuesday February 17th from 6pm to 9pm in the village board room, 1 Maple Street, New York Mills.

Census Bureau Request - Resolution 10 for 2009 - Trustee Bialek made a motion seconded by Trustee McCoy to allow the Census Bureau to use the board room Tuesday February 17th and Tuesday March 3rd for training and testing for the 2010 census takers from 9:30 am to 3:30 pm both days.

Tax Bill Program - Village Clerk and Village Assessor attended a meeting at the Village of New Hartford with the County and New York State representatives regarding our village tax bills.  The V3 program the county is using for us is no longer available therefore we need to update to the V4 (version four) program.  Trustee Bialek would like to look into this before we go any further.

N.O.C.C. Grant Opportunity - Resolution 11 for 2009 - Trustee Semeniak made a motion seconded by Trustee McCoy to approve a resolution to join the Town of Deerfield's New York State Archives Ancestry Grant.

Memory Book Page - Resolution 12 for 2009 - Trustee Jarosz made a motion seconded by Trustee Semeniak to add a memory book page for Ted Kaczor to the official minute's book.  (See attached)

Resolution from the City of Utica - received a resolution from the City of Utica expressing dissatisfaction with the Count taking away the OTB monies.  Board tabled to next month.

Energy Efficiencies and Alternatives - will be held at Boonville Municipal Building Tuesday January 20th from 1pm to 4:30 pm.  Let the Clerk know if you would like to attend.

Tug Hill Conference - will be Thursday March 26th at Jefferson Community College, please let the Clerk know as soon as possible so registration can be completed.

Council of Villages we are host village this year.  We will be changing back to the banquet which will be sometime in March.  More news to follow.

OLD BUSINESS

Police Chief Vacancy - Mayor Maciol would like to officially thank Sgt. Soja for doing an extremely fine job since October holding the police department together.

Mayor explained the steps that have been taken so far to hire a Chief of Police:

•1.      Interviewed four (4) candidates who were on the Civil Service list;

•2.      Interviewed one (1) full time current member of the Police Department;

•3.      Interviewed one (1) part time member of the Police Department;

•4.      Explored the possibility of sharing a chief;

•5.      Continuing to work with the Council of Villages as the consolidation option is explored.

Mayor has contacted the County for a new list, which a new test will be given.

Resolution 13 for 2009 - Trustee Semeniak made a motion seconded by Trustee Jarosz to appoint Officer Joe Palmer as Acting Police Chief Part Time to the New York Mills Police Department at an hourly rate of $21.15. Trustee Semeniak feels Officer Palmer is an exceptional person with great leadership and commends him for wanting to accept this position.

Police Consolidation Update - Mayor said they had a meeting four weeks ago at the County Executive's Office and Mayor Pugh agreed to set another workshop for the end of January.

Energy Study - nothing further to report

NYRI - had testimonies that the NYRI's application is not a good application.

TRUSTEE BUSINESS

Trustee McCoy - would like to thank the Fire Department and the Police Department for their quick response to his parents accidents.

Trustee Bialek - power study - looking at it in New Hartford.

Trustee Jarosz - nothing

Trustee Semeniak - asked about the Library Tech position, Mayor stated they are still interviewing.

Trustee McCoy made a motion seconded by Trustee Bialek to adjourn the meeting.

Mayor Maciol adjourned the meeting at 8:45 pm.
