June 24, 2008: Special Board Meeting

Mayor Maciol called the special meeting to order at 7 PM followed by the pledge to the flag and roll call.

Present:  Mayor Maciol, Trustee Jarosz, Trustee McCoy and Trustee Semeniak

Absent:  Trustee Bialek

OPEN FORUM

 William Szczerba - 54 Country Club Drive, complained of an un-sightly tree house that is visible from his backyard.  Mayor referred him to the Codes Officer.

Joe Pacini - 210 Comenale Crescent asked the board permission to volunteer to hold a tee ball/minor league pre league at Pietryka Park from July 14th to August 14th similar to the basketball program approved by the board two weeks ago.  On a motion by Trustee Semeniak and a second by Trustee Jarosz his request was approved pending the Attorney's approval of the wording of the liability waiver.

NEW BUSINESS

Resolution 66-2008 - Motion by trustee Semeniak, second by Trustee Jarosz to take the police consolidation study to the next level of study along with Whitesboro, Yorkville, Oriskany, and Whitestown to include, but not be limited to, the appointment of a police steering committee and the writing to our state and federal leaders to seek funding to allow for professional assistance during the study.  All present are in favor.

Resolution 67-2008 - Motion by Trustee Jarosz, second by Trustee McCoy to approve Judge Glenn's request to attend the Magistrates training in Niagara Falls on September 21-23.

Mayor informed the board of the Hilltop Seniors luncheon on Thursday at the Roselawn at 1 pm.

Resolution 68-2008 - Motion by Trustee McCoy, seconded by Trustee Jarosz to approve Fire Chief Glenn's request to utilize a village vehicle to attend the "Firehouse Expo" in Maryland on July 25-27.

Mayor informed the board of the Little League picnic on Thursday at 5 pm.  Trustee McCoy will be presenting the Mayor's Trophy for Mayor Maciol as he has a family commitment to attend.

Resolution 69-2008 -

On a motion by Trustee Semeniak, seconded by Trustee Jarosz the following resolution regarding the obtaining and selling of "Offset I/I credits" was passed:

WHEREAS, the New York State Department of Environmental Conservation (NYSDEC) has issued a Consent Order, No. R6-20060823-67, against Oneida County, and

WHEREAS, the Village of New York Mills is one of nine member municipalities of the Oneida County Sewer District and is subject to the requirements of the Consent order, and

WHEREAS, the Consent order stipulate a 5:1 removal ratio from the district's collection system tributary to the Sauquoit Creed Pump Station for any new connection to the sanitary sewer system, and for significant increases sanity sewage flow resulting from a change in use of a property whose sanitary flow is tributary to the Sauquoit Creek Pump Station, and

WHEREAS, the Consent Order mandates the County to prepare an Inflow and Infiltration (I/I) Offset Plan (Plan) which lays out an initial approach for (I/I) removal from the collection system that will allow, based on the 5:1 removal ratio, a commensurate amount of economic development to continue, and

WHEREAS, NYSDEC has approved the April 2, 2008 Inflow and Infiltration (I/I) Offset Plan submitted by Oneida County (Exhibit A), and

WHEREAS, the Plan provides for member municipalities to implement I/I removal projects that are approved by the County and that will result in the generation of offset flow credits, and to deposit those offset flow credits into a municipal offset credit bank that will be administered by the County, and

WHEREAS, the Plan provides for each member municipality, via application to and permission from the County, to sell those flow credits into a developer in need of flow credits to construct an economic development project, and

WHEREAS, the Plan allows for each member municipality to establish a sale price for each gallon of flow credit, and

WHEREAS, the Village of New York Mills has developed criteria for establishing the sale price for each gallon of flow credit.

THEREFORE BE IT RESOLVED that the Village of New York Mills, being a member of the Oneida County Sewer District, is subject to the mandates of a New York State Department of Environmental Conservation (NYSDEC) Consent Order No. R6-20060823-67 against Oneida County, and

RESOLVED, that in compliance with the mandated of said Consent Order, an Infiltration and Inflow (I/I) Offset Plan (Plan) was submitted by Oneida County to NYSDEC and has now been accepted by NYSDEC, and

RESOLVED, that said Plan allows for the municipal district members to implement certain I/I removal projects, and by the completion of those project to generate offset flow credits that will be deposited in the municipality's offset flow credit bank, and that with the permission of the County, to sell those flow credits to developers needing said credits to progress economic development projects, and

RESOLVED, that the Village of New York Mills does establish a sale price of $4.00 per gallon of flow credit, flow credit being defined as the actual amount of new or increased sanitary sewage flow generated per day by the economic development project and as approved by the County for that economic development project, as opposed to the amount of I/I required to be removed from the collection system to meet the 5:1 offset ratio, and

RESOLVED, that the 5:1 offset ratio computation may be diminished by twenty (20) percent if the developer can substantiate to the Codes Enforcement Officer that low flow plumbing fixtures are installed throughout the structure, if new, and that all plumbing fixtures are replaced with low flow fixtures in renovated structures, and

RESOLVED, that the $4,00 sale price shall be for all types of economic development projects determined to be subject to the offset credit requirement, excepting residential strip development on building lots existing on the date of adoption of this resolution; those offset credits shall be computed at a rate of $2,00 per gallon, and

RESOLVED, that all single family residential shall be computed using the standard of four (4) bedrooms per residential unit, equating to a flow rate of 475 gpd, or as subsequently modified by NYSDEC, and

RESOLVED, that the monies realized by the Village through the sale of offset credits shall be deposited in a special sewer account designated specifically for funds to advance additional I/I removal projects, and

RESOLVED, that the Village of New York Mills retains the right to change or modify the established price per gallon for offset flow credits at any time, but resolves to review the established price, at a minimum, on a bi-annual basis.

Mayor informed the Board of a letter he received from Michael Majka stating that his daughter broke her arm at Pulaski Park.  Our insurance company will be notified by the Clerk.

Mayor informed the Board that our paving specs are done and are out.

Trustee McCoy informed the Board that the illegal dumping complaint on Clinton Street appears to have been taken care of by Codes Officer Neary.

Trustee Jarosz informed the Board he is still working on the air conditioning matter.  Calls to Walt Wojnas have been un-answered.

Trustee Semeniak updated the Board on his in-depth health insurance study.  There is a lot of information to digest and will take some time.

Motion by Trustee Semeniak and a second by trustee Jarosz to enter into Executive Session at 7:42 pm to discuss the ongoing labor negotiations with the Police Department.

Motion by Trustee McCoy and a second by Trustee Jarosz to exit the Executive Session at 10:09 pm with no action taken.
