March 13, 2007: Regular Board Meeting

Body:
 

Mayor Maciol called the meeting to order at 7:03 PM followed by the pledge to the flag and roll call.

Present:  Mayor Maciol, Trustee Baryla-white, Trustee Bialek, Trustee Jarosz and Trustee Semeniak

 

OPEN FORUM

Martha Toczydlowski - of Parkside Court is concerned with the parking problem on the upper part of Parkside Ct. Would like to see no parking continued from the lower part of Parkside right to the end of the street.  People are parking on both sides of the street making it hard to get through.

Trustee Jarosz made a motion seconded by Trustee White to hold a public hearing on April 10th at 7PM for Local Law #2 for 2007 to prohibit parking on the south side of Parkside Court from Glod to the end of Parkside. 

Marty also thanked Trustee Jarosz and Chief Frankland for their help when the tree fell on their car.

 

REGULAR BUSINESS

Trustee Semeniak made a motion seconded by Trustee White to accept Abstract #10; General vouchers A585-A647 in the amount of $80,481.09 and Library vouchers L093-L101 in the amount of $3,137.61 for a total of $83,618.70.

 

Trustee White made a motion seconded by Trustee Semeniak to accept the February Treasurers report as presented.  Check numbers for February; General 10580-10651, payroll 5839-5903.

 

Trustee Semeniak made a motion seconded by Trustee Jarosz to approve the minutes from the February 13th board meeting.

Trustee White made a motion seconded by Trustee Jarosz to approve the minutes of the February 20th workshop.

Trustee Jarosz made a motion seconded by Trustee Semeniak to approve the minutes of the February 24th workshop.

Trustee Semeniak made a motion seconded by Trustee White to approve the minutes of the February 27th workshop.

 

DEPARTMENTS

Recreation - Trustee White reported the summer park jobs have been posted and she received seven applications.  Trustee White made a motion seconded by Trustee Semeniak to appoint Nick Houle, Anna Moskal - part time, Virginia Vanderpool and Melody Polak as park attendants.

 

Police - Chief Frankland gave his report which is on file in the Clerk's office. Trustee Semeniak made a motion seconded by Trustee Jarosz to appoint Nicholas Dean to fill the full time vacancy pursuant to approval by civil service.

Trustee Semeniak made a motion seconded by Trustee Jarosz to appoint Mark Sojda as part time police officer to fill the vacancy left by Officer Elderkin.

Trustee White made a motion seconded by Trustee Semeniak to approve the police written report.

 

Highway - Joe gave his report, Clerk did not received a report for the file.  Trustee Semeniak commended the highway for the snow removal during February and March.  Received a thank you from the Town of New Hartford for demonstrating our sidewalk snow blower.

Trustee White made a motion seconded by Trustee Semeniak to approve the highway report.

 

Fire Department - Mayor Maciol attended two meetings with Supervisor Shannon and explained what was discussed.  There is a third meeting scheduled for tomorrow. The villages would like one-year contracts with our full amount requested.  Will keep us updated.

 

Code Enforcement - no report

 

Engineer - Al reported the annexation maps are done and Bill will disburse them.  Al stated when the weather improves the surveyor will set the monuments at the new village corners.

MS4 -

•Ø      At the last Planning Board meeting there was a discussion of ordinance changes associated with implementing DEC mandated Stormwater review criteria in site plan review process. 

•Ø      Ordinance changes associated with Stormwater discharge to municipal storm sewers being prepared for review

•Ø      Manual of municipal housekeeping practices being prepared with the Highway Dept.

•Ø      Training CD entitled "Stormwater" rented from OC Planning for use with Highway Dept.  Illustrates practices and procedures to minimize pollution of waterways through municipal activities. A schedule is being developed.

Trustee Bialek is concerned with the fire department apron; maybe we should look into replacing the complete apron instead of just sections in which the overall appearance will be affected.  Al will get a current price for next months meeting.

NEW BUSINESS

Newsletter Articles - please have them to the clerk by Friday March 30th.

 

Planning Board Resolution - Trustee Jarosz made a motion seconded by Trustee White to accept and approve the following recommendation from the planning board:  the planning board is fine with the plans submitted by Lupini construction to build a cold storage building 23 feet by 80 feet at 11 Mill Street.  Lupini has agreed to install a swale to divert storm water to Mill Street and to build the cold storage building 12 feet from the property line per singed site plan.

 

Judicial Resolution - Trustee Jarosz made a motion seconded by Trustee Bialek to approve the following resolution:

WHEREAS, the Village of New York Mills has been made aware of recent publications in areas around the state that question the importance, integrity, and level of expertise in Town and Village Courts.  We also are aware of an agenda by some to establish District Courts Statewide.  One proposal calls for the 48 courts in Oneida County be replaced with one District Court.

WHEREAS, the Village of New York Mills is also aware of a "Action Plan for the Justice Courts" by Chief Judge Judith Kaye that would increase training, security, and oversight of our courts around the state. This plan has been embraced locally by the Oneida County Magistrates Association.

WHEREAS, the Village of New York Mills recognizes the dedication, commitment, and importance of our court and the many others in the state.

Now therefore be it resolved that the Village of New York Mills goes on record supporting the local courts and we also go on record supporting the proposals to improve our courts as recommended by Chief Judge Judith Kaye.

Grievance Results:  received the following grievances at Grievance Day:

•7.507    Burrstone Associates - tentative assessment 736,950, requesting 575,065.

They are asking to reduce their assessment by 161,885.  Trustee Bialek made a motion seconded by Trustee Jarosz to deny the request for this reduction.

Census 2010 - Mayor explained a little about the upcoming census and the amount of time that will be involved.  More information to follow.

 

Organizational Meeting - Trustee Bialek made a motion seconded by Trustee White to hold the Annual Organizational Meeting Monday April 2nd at 7 PM.

 

2007/2008 Budget - Trustee Jarosz made a motion seconded by Trustee White to hold a public hearing on the 2007/2008 budget on Monday April 2nd at 7:15 PM.

Trustee Semeniak made a motion seconded by Trustee White to award the bid to Charles Gaetano at the bid of $133,000.00.

Davis Wallbridge did not provide a statement of non-collusion, therefore they were disqualified.  Trustee Semeniak made a motion seconded by Trustee White to award the bid to North Paving at the bid of $142,507.00.

 

TRUSTEE BUSINESS

Trustee Baryla-white - nothing

Trustee Bialek - nothing

Trustee Jarosz - concerned with the low cost of renting the park pavilions, too much garbage is left behind which is costly to us to clean up. Please think about it for next month.

Trustee Semeniak - nothing

 

With no further business, Trustee Semeniak made a motion seconded by Trustee White to adjourn the meeting.

 

Mayor Maciol adjourned the meeting at 9:20 pm.
